- Comply with Meta, TikTok, and other platform terms of service for accounts under our management

- Content we create for you as part of a service agreement (posts, graphics, captions, ad copy) becomes your property upon full payment for the relevant period
- We retain the right to use work created for you in our portfolio and marketing materials unless otherwise agreed in writing
- Our proprietary systems, strategies, and frameworks (including the "Elevate Growth System") remain our intellectual property at all times
8. AI-Assisted Services
We use artificial intelligence tools to assist in generating social media responses, content suggestions, and marketing copy. By engaging our services, you acknowledge and agree that:
- AI tools may be used as part of our service delivery
- All AI-generated content is reviewed and managed by our team
- We are not liable for any unintended or inaccurate AI-generated responses that are published before human review
9. Limitation of Liability
To the maximum extent permitted by South African law:
- Elevate Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services
- We shall not be liable for any loss of profit, revenue, data, or business opportunity
- Our total liability for any claim arising from our services shall not exceed the total fees paid by you to us in the 3 months preceding the claim
- We are not liable for any actions taken by Meta, TikTok, Google, or other third-party platforms (including account suspensions, algorithm changes, or policy enforcement)
- We are not liable for downtime, errors, or interruptions caused by third-party hosting or platform providers
10. Indemnification
You agree to indemnify and hold harmless Elevate Digital, its owner, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Your breach of any applicable law
- Content you provide to us that infringes third-party rights
- Your use of our website or services
11. Termination
Service agreements are subject to their own termination provisions. With respect to this website:
- We may suspend or terminate your access at any time, without notice, for any breach of these Terms
